TERMS OF USE (“TOU”)

System Description

The Land Transportation Office (“LTO”) Official Receipt (“OR”) and Certificate of Registration (“CR”) Web Verification Facility (“System”) is an online web-based application system which allows the motoring public (“User/s,” “Data Subjects”) to validate the OR and CR issued by the LTO for transactions processed through the LTO-IT System, and to display select information upon encoding of a valid OR and/ or CR number as search key.

Privacy Statement

In the exercise of its functions which include the registration of motor vehicles, among others, pursuant to Republic Act No. 4136, as amended, otherwise known as the Land Transportation and Traffic Code, the LTO is legally authorized to process the personal information of its clients.

Users must provide/ input the required information to check the validity of OR and/ or CR.

The LTO is committed to ensure that personal data of its Data Subjects are protected. The personal data will be processed in accordance with relevant laws governing the LTO services and following the requirements of the Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012, its Implementing Rules and Regulations (IRR) and other issuances of the National Privacy Commission (NPC).

The Processing includes but not limited to, the collection, recording, organization, storage, updating or modification, retrieval, consultation, use, consolidation, blocking, erasure, or destruction of personal information.

All personal data will be kept in a secure and confidential manner by implementing organizational, physical, and technical security measures for personal data protection.

Acceptable Use

The System shall only be used to check the validity and authenticity of the OR/CR, and to verify if the information in the OR/CR has not been tampered with.

Authorized User Responsibility

By using the System, you agree and commit:

1. To use the System for authorized purposes only;
2. To immediately notify the LTO if you have reason to believe that your personal information was mishandled, or its confidentiality or integrity was violated, or there is a breach of security;
3. Not to use the System in any way that causes, or may cause damage to the Data Subjects, the LTO and the System or impairment of the confidentiality, availability, and integrity of information and the System; or in any way which is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity; and
4. Not to use the System in any way which is linked to any spyware, computer virus or other malicious computer software.

By using the System:

1. You consent to the processing of your personal information, which is necessary in granting you access to the System.
2. You represent and warrant that any information you provide is accurate/ complete and/or you have the authority to provide such information.
3. You confirm that you will not disclose any information accessed/ retrieved using the System without express authority from LTO.
4. You agree not to use the information accessed through the System for purposes other than the intended purpose of the System.
5. You understand that the System will not be available at all times and the information on the System may be subject to change or correction if deemed necessary by LTO.
6. You are bound by this TOU.

Suspension/ Termination of Access

Access of User/s who will violate the TOU or abuse the use of the System or abuse the use of information therein, may be suspended/ disabled and/or terminated by LTO without prior notice, subject to applicable penalties and/ or fines.

LTO also reserves the right to suspend or terminate access to the System at its discretion.

Intellectual Property

All trademarks, trade names, service marks and logos in the System are property of their respective owners and shall not be used without prior approval.

Modifications

In case of typographical errors and inaccuracies, the LTO reserves the right to rectify the same, or update the information in the System without prior notice.

Updates on TOU

The TOU is subject to regular review and may be updated through changes posted on this website without prior notice to the users.

DATA PRIVACY NOTICE

1. Introduction

The purpose of this page is to inform you of our policies regarding the collection, use, storage, disclosure, and disposal of personal information we receive from the users of this website.

The Land Transportation Office (LTO) is committed to ensuring that your personal information are protected and secured. Should we ask you to provide certain information, by which you can be identified you can be assured that it will only be used in accordance with the law and this Data Privacy Policy.

We shall use your personal information to provide you services pursuant to our mandate under Republic Act No. 4136 otherwise known as the "Land Transportation and Traffic Code," as amended, and Republic Act No. 8792, otherwise known as the "Electronic Commerce Act."

By using our site and availing of our services, you consent to the processing of your personal information in accordance with this Data Privacy Policy.

2. Collection and Use of Personal Data

Under Section 3(g) of Republic Act No. 10173, Known as the “Data Privacy Act of 2012,” Personal information shall refer to: “any information, whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.”

Under Section 11 of RA 10173, the processing of personal information shall be allowed, subject to compliance with the requirements of RA 10173 and other laws allowing the disclosure of information to the public and adherence to the principles of transparency, legitimate purpose, and proportionality.

Under Section 3(j), processing shall include the collection, recording, organization, storage, updating or modification, retrieval. consultation, use consolidation, blocking, erasure or destruction of the data.

For you to avail of our services, we may require you to submit personal information in order to process the online transactions of your driver's license and motor vehicle registration, such as:

1. Full Name;
2. Birth Date;
3. Place of Birth;
4. Home Address;
5. Gender;
6. Civil Status;
7. Citizenship;
8. Father's Name;
9. Mother's Name;
10. Height;
11. Weight;
12. Tax Identification Number; and,
13. Driver's License Number.

[Note: The System enables Users to validate the information in the Official Receipt (OR) and Certificate of Registration (CR) issued by the LTO against the information electronically retrieved and displayed by the System for transactions processed through the LTO-IT System.

The System shall retrieve and display one or more of the following information depending on the data encoded: OR Number, CR Number, Transaction Date, Transaction ID, Transaction Type, Engine Number, Chassis Number, Plate Number, Make, Series, Motor Vehicle (MV) File Number, Driver’s License (DL) Number, and Clearance/ Violations.]

3. Information Control and Limitation

You have the right to request for a copy of any personal data we hold about you, and have it corrected if you think it is inaccurate or incomplete. If you wish to request to do so, please reach out to us through our contact information.

We will promptly respond to your request and execute the corresponding corrections of any information found to be incorrect or incomplete.

4. Security

We are committed to ensuring the safety and security of your personal information. Nevertheless, keep in mind that no method of transmission over the internet or method of electronic storage will guarantee full security.

In order to prevent unauthorized access or disclosure, we have implemented physical, technical, and organizational measures and procedures to safeguard the data we collect from you. While we use such means and methods to protect your personal data, we cannot guarantee its absolute security.

5. Log Data

We collect information that your browser sends whenever you visit our site. This Log Data may include information such as your computer's Internet Protocol (IP) address, browser type, browser version, the pages of our site that you visit, the time and date of your visit, time spent on those pages, and other statistics.

6. Links to other websites

Our site may contain links to other websites of interest. Once you access these links to leave our site, please note that we do not have any control over that other website. Therefore, we cannot be held responsible for the protection and privacy of any personal information which you provide whilst visiting such site; and such sites are not governed by this Data Privacy Policy.

7. Personal Information Retention and Disposal

We keep personal data only for as long as it is necessary and only for the fulfilment of the declared, specified, and legitimate purposes provided above, or when the processing relevant to the purpose has been terminated.

After which, personal data shall be disposed or discarded in a secure manner that would prevent further processing, unauthorized access, or disclosure to any other party or the public, or prejudice the interests of the data subjects.

8. Changes to this Data Privacy Policy

We will review regularly our Privacy Policy and we reserve the right to update and modify it at any time. Revisions to this Data Privacy Policy will be posted on this site.
